Conditions for complaints
1. General provisions
- These complaint conditions apply to all products sold by carpe event productions GmbH & Co. KG (hereinafter "seller") under the clickwand brand.
2. Notification of defects
- Obvious defects must be reported in writing within 24 hours of receipt of the goods. Hidden defects must be reported in writing immediately after they are discovered, but no later than 7 days after discovery. The notification period for hidden defects is 2 years.
- The notification of defects must contain a detailed description of the defect and images.
3. Warranty and liability
- In the event of justified complaints, the seller will repair the goods or provide a replacement at its own discretion. If the repair or replacement fails, the buyer can only then demand a reduction in price or withdraw from the contract.
- Further claims, in particular claims for damages, are excluded unless they are based on intent or gross negligence on the part of the seller.
4. Exclusion of warranty
- No warranty is provided for damage caused by improper use (such as omitting the metal connectors (W-W and W-S) at all or some wall transitions, not using a right angle with the intended support and a wall element of at least 96 cm wide for stabilization, etc.), normal wear and tear, or external influences for which the seller is not responsible.
- The warranty expires if the buyer makes unauthorized changes or repairs to the goods.
5. Returns
- Returns must be approved in writing by the seller in advance. Goods returned freight collect will not be accepted.
- The buyer bears the costs and risk of the return, unless the return is due to a legitimate defect.
6. Restrictions
- Liability for indirect damage, lost profits or other financial losses of the buyer is excluded to the extent permitted by law.
- For products that have been manufactured according to customer specifications, cancellation or return is excluded unless there is a significant defect (e.g. production error).
7. Place of jurisdiction and applicable law
- The place of jurisdiction for all disputes arising from this contractual relationship is the registered office of the seller. The law of the Federal Republic of Germany applies.
